Location of value
As product value resides in the composition, protection is established at that point.

The profile of a fragrance composition is recorded as a reference. This record forms the basis for distinguishing counterfeits and for demonstrating consistency across batches.
Implementation
A structure that converts the composition into a recorded reference. The profile of the approved composition is recorded as a reference and forms the basis of subsequent examinations. Whether product obtained from the market carries the brand composition is reported. Correspondence between an essence batch received from a supplier and the previous batch is confirmed before it enters production.
In fragrance the entire value resides in the composition. The bottle and packaging can be reproduced; the composition itself carries the character of a distinguishing signature.
The issues that stand out in this product group are as follows. Counterfeit products carry an exact reproduction of the bottle and packaging. Demonstrating that a composition has been reproduced requires a technical finding. In essence supply, consistency across batches is a separate matter of confirmation. Which batch a product observed on the grey market belongs to remains unclear.

Regulation
Requires a responsible person established in the EU for every cosmetic product placed on the EU market, electronic notification before the product is placed on the market, and a batch number or a reference identifying the product on the label. Having batch information on the product forms the basis of traceability in recalls and complaint investigations.
In Türkiye, cosmetic products must be notified to the Ministry of Health before they are placed on the market for the first time; the responsible person files the notification with TİTCK through the Product Tracking System (ÜTS), together with the product's original label. This record is the primary source consulted when identifying which responsible person a product on the market belongs to.
